Russell Brand Might Get $20 Million in Divorce From Katy Perry

Russell Brand's divorce from singer Katy Perry could make him $20 million richer, thanks to California law and the couple's reported decision not to sign a prenuptial agreement when they tied the knot 14 months ago.

The comedian, 36, who filed for divorce Friday, told New York magazine last year that the couple did not sign a pre-nup prior to their Oct. 23, 2010, wedding in India after a yearlong, whirlwind romance.

Under California law, without a pre-nup, the couple, who met at the 2009 MTV Music Awards, must split their earnings 50/50.

Forbes magazine reports Perry, 27, the singer behind hits such as "Last Friday Night" and "Fireworks," is worth at least $44 million.

The projected divorce payout would out-value even Brand himself, who is estimated to be worth around $15 million.

The "Arthur" star released a statement Friday announcing the divorce: "Sadly, Katy and I are ending our marriage. I'll always adore her and I know we'll remain friends."

Divorce papers filed by Brand's lawyers at Los Angeles Superior Court cited "irreconcilable differences," according to TMZ, which obtained the divorce documents.

The first public signs of difficulties between the couple came around Christmas when the two were spotted celebrating thousands of miles apart - Brand in Britain with his family and Perry in Hawaii - and without their wedding rings.  Us Weekly reported that Perry and Brand had "a massive fight" just before the holiday.

"This split was something that's been discussed," Ian Drew, senior editor at Us Weekly, told ABC News.

"Did she know that he would draw up papers during a holiday right before New Year's Eve?  I think that was a big surprise," he said.

Just one month earlier, Perry told ABC News' Barbara Walters in an interview that all was well in the couple's marriage, and that she envisioned starting a family with Brand. "I think that it's lovely so far," the singer said of their marriage.

"Yes, of course," she responded, when asked about having kids together.  "I think that is one of the big reasons why you do get married."

Sources close to the couple say that Perry's partying was upsetting to Brand, a recovering heroin addict, and that he did not approve of her circle of friends, who include A-list names such as fellow pop star Rihanna.

It was also reported that Brand submitted the divorce papers at the request of Perry, who did not want to upset her parents.

Reps for Perry and Brand did not respond to ABCNews.com's requests for comment Friday.

Perry has remained quiet on the split, while Brand spoke out to reporters this weekend. "I'm doing good," he told London's Daily Star. "Everything is going to be better next year."

      ya they would have to grow up the same way millions apon millions of other children had to grow up and become productive members of society glad those rich folk didnt do it too. and by the way the day my mother finally got rid of my father was the happiest day in my life!!! it isnt always the best thing for children to have both parents married. but am glad your "SO" relieved

      I would be extremely disappointed in Russel Brand if he takes a dime from her, but...you are right. Men are often so royally screwed in a divorce, I'm amazed that so many bother to marry. My ex-husband got screwed in his divorce from his first wife, and I was always really angry about that, and about how men are treated like open bank accounts to their ex's. Then my husband screwed me out of $8,000 when we divorced. Go figure.

      his utter and unrelenting condemnation of her parents and her family is the root of all this not his substance problems, after all the substances are not going up his nose or in his arm but they are being poured down his gullet at an unbelievable measure. as for substances he only traded one issue for another one so he can not blame that on her he needs to man up and tell the truth about being such a total jackwagon to her family all this time. he is a piece of excrement.

      His recovery first???? What recovery? The reason they are divorcing is because he is a sex addict! She could not handle it anymore, dealing with him and his attitude! Tea Leoni & David Duchovny went through the same thing, but in the end, Tea divorced David. Russell & Katy explained why they are divorcing and that is why! Their fights were non stop, they are parting on amicable terms.

      Women who have the kind of money Brand has don't usually do that after one year, when the divorce is amicable. Most women who get a huge settlement were either married for years, or to a cheater or to someone who treated them badly, or have several children and/or little or no money of their own. If I were in his position---worth $15million and married to someone worth $44 million, I would call it a draw unless he had fathered a child with the maid or beaten the hell out of me during the marriage.

      It's called a double standard, Gradius, and America is full of them. Many womenin America think nothing of taking half a man's fortune when they want to split up, and 65 percent of divorces are filed by WOMEN. But when the shoe is on the other foot, you see them aghast that Katy should have to pay up. I hope he socks it to her. Show the whole #$%$ nation that what is good for the gander is good for the goose. He certainly DOES DESERVE HALF-- under the same California laws that screw men every single day. So sing about your fireworks and write that check out to CASH, Miss Perry!

    Wow, excellently *incorrect* article, YooHoo. 3rd paragraph states it: They have to split their EARNINGS during their marriage 50/50.

    Unless Katy earned all $44M in the last 14 months, this article is almost criminally incorrect. Only 1/2 of what she earned since Oct 2010 minus 1/2 of what he earned since that same date. MAX.

    What the article doesn't state, is that the courts can change it. Only after 10 years, can it be guaranteed to be enforced. One reason (the public speculated) that Tom Cruise filed for divorce like 9.5 years after marrying Nicole Kidman.

    Just because a law says you are entitled to half of your spouses earnings, doesn't mean you must seek half of your spouse's earnings. Anyone with class would just walk away from the marriage and live off his or her own merits, not someone else's.
