Woman Claims Hotel Gave Drunken Man Her Room Key

A New York business woman is suing Starwood Hotels and Resorts Worldwide, claiming staff at one of their hotels gave her room key to a drunken man who allegedly sexually assaulted her in her bed.

Alison Fournier announced the suit today at a news conference with women's rights lawyer Gloria Allred.

According to the suit, Fournier was in her locked room in Hotel Kämp, a hotel operated by Starwood Hotels in Helsinki, Finland, on the night of Jan. 15, 2011 when she was sexually assaulted.

The man, who was "visibly intoxicated," had undressed, slipped into her bed, and proceeded to grope her naked body, the suit says.

Fournier, who is represented by Allred and the New York firm Cuti Hecker Wang LLP, is suing the company for negligence and negligent infliction of emotional distress for an amount to be determined at trial.

Fournier was traveling to Helinski for work and said that she specifically chose a Starwood hotel because of the company's reputation.

"Starwood is the go-to brand for business travelers and I expected a certain level of security from their hotels," Fournier said in a statement.

But instead of security, Fournier said she found susceptibility.

According to a release that Allred sent out, a man approached Fournier the night of the incident, expressing a sexual interest in her. According to Allred, Fournier had made it very clear that she was not interested in him and retreated to her room to get away.

That same man, according to the suit, later went to the front desk, said that he was Fournier's husband, and obtained a key from hotel staff to her room.

The staff did not ask him for any identification or proof that he was in fact Fournier's husband, according to the lawsuit. He then proceeded to her room and tried to molest her. She awoke, grabbed a housecoat, and ran screaming from the room.

"To this day, I still suffer from the memories of that night and I am still not able to put it behind me," Fournier said.

She said that, because of the incident, she left her career and moved from New York to be closer to her family.

The suit alleges that there is no indication that Starwood has taken any action to investigate the incident at Hotel Kämp or to disassociate itself from the Finnish hotel.

In a statement given to ABC News by Starwoods Hotels and Resorts, Worldwide, the company said it is investigating the incident.

"The safety and security of our guests is our first and foremost priority. It is company-wide policy to ensure proper identification is shown and verified before distributing a key to a registered guest's room," the statement said. "We are taking this allegation seriously and are working with the hotel in question to understand the facts and any breach of security that may have contributed to this very unfortunate event. "

Allred said the case is representative of a bigger problem than a personal assault, because women, particularly businesswoman, have a right to feel safe when traveling and staying at well known hotels.

"Business women have a right to safety and security and especially need that safety and security when traveling abroad," Allred told ABC News. "They are particualrly vulnerable when traveling alone. Starwood's negligence, misconduct and reckless disregard for the safety of Ms. Fournier has led to devastating and life changing consequences for her. ... They need to be fully accountable and make sure that this never happens again."

      Reading the article, it appears they were in the same place at the same time and had gotten familiar enough for him to tell her he was sexually interested in her. I am a woman and while in earlier years I had men express an intereest in me none ever just came up out of nowhere and said they wanted to have sex. A mutual interest of some kind had to have been shared whether intentionally or unintentionally. Intoxicated or not, men and women need to be more careful of the vibes they give off if they don't want something like this to happen. As usual it is blown all out of proportion. I have never been in even the cheapest, lowclass hotel where they turned over the extra key to anyone . All the desk clerks have always called announcing there was someone being brought to the room. I can say she needs to be more careful of associations especially in a drinking situation.

      Well, he may have followed her and there should be security video of that, but this case is way too old for any type of verification probably. He may have been so drunk that he was out spoken about his sexual attraction, but I'm still skeptical because she waited so long to complain. And the choice of attorney....

    It’s sad….this incident may have been every bit as horrific as she describes, but when you hire Gloria Allred it gives the appearance of a money-grab….because that’s who Allred is.

      @Rob: Just because she goes after high profile cases doesn't make her cases less important. And she has a pretty good track record:

      She claimed HP's last CEO sexually harassed her client at a corporate function. He ended up resigning because there was substantial evidence that he crossed the line.

      She claimed Anthony Weiner asked her client to lie for him about his sexually-oriented text messages. He ended up admitting to sending numerous sexually-oriented text messages to numerous women.

      She claimed Herman Cain sexually harassed her client at a hotel bar, years ago. He ended up dropping out of the Republican primary after other women stepped forward to level similar charges.

      She may be an ambulance chaser, a glory hound and other horrible things. But she's often right on these sorts of things.

    I work the front desk of a hotel and this is a very fine line when you are working and guests come up and ask for keys to 'their' rooms,, all guests do NOT put themselves in the hotel register.. husbands check in and have their wives with them but don't add their wives names to the room and same for wives, they do not add their husbands name to the desk.. the desk clerk other then yes, asking for ID, but that does not mean both guests, even if he said they were married will have the same last name, although that should not matter.. the desk clerk should have called the room regardless of the hour and ask if this person could have a key to that room.. and the guest being drunk should have sent off bells to the desk clerk..

    She had to leave her career because she was GROPED? If there IS a case, then it should be against the DRUNK, and it should be a CRIMINAL case of sexual assault. Did this career woman REPORT this attack to the AUTHORITIES, or was she just waiting for a high priced lawyer to advise her? I don't know what the circumstances were, but if there was a sexual assault, it SHOULD have been reported to the authorities.

    I work in a hotel. And i never give a key to anyone without ID or verification that person is even staying in the hotel. But then again im not suprised to see Gloria Allred all over this. Especially with her #$%$ Anti-male Agenda

    Too many details left out of this story for me to have an opinion, BUT this alleged incident happened in Finland in January 2011!

    Did this alleged victim report the sexual assault to the Helsinki police a year ago? If so, what happened? Did she report it to the hotel in Helsinki at the time of the incident? What did the hotel say or do; what did the Starwood chain say or do over the past year? Or did she not tell anyone?

    Why are we hearing about it now, a year later, in the United States, and with the involvement of Gloria Allred? If it happened as described, it is an outrageous incident and Ms. Fournier has my support and sympathy, even if her carelessness enabled the attacker to enter her room while she slept. According to a press release sent out by Gloria Allred a man approached Fournier the night of the incident, expressing a sexual interest in her. Fournier had made it very clear that she was not interested in him and retreated to her room to get away. So, she fled to her room to get away from a drunk interested in sex and decides not to use the security lock? Something just does not track here.
